THIS AGREEMENT CONTAINS ARBITRATION AND CLASS ACTION WAIVER PROVISIONS THAT WAIVE YOUR RIGHT TO A COURT HEARING, RIGHT TO A JURY TRIAL, AND RIGHT TO PARTICIPATE IN A CLASS ACTION. ARBITRATION IS MANDATORY AND IS THE EXCLUSIVE REMEDY FOR ANY AND ALL DISPUTES UNLESS YOU OPT OUT AS DESCRIBED IN SECTION 15. PLEASE REVIEW SECTION 15 CAREFULLY.

Novablue Labs products are cosmetics regulated under the U.S. Federal Food, Drug, and Cosmetic Act (FDCA) and the Modernization of Cosmetics Regulation Act of 2022 (MoCRA). It is essential to follow the instructions provided on product packaging and to discontinue use if irritation occurs. Users assume responsibility for using our products in accordance with the provided directions. See Sections 13 and 14 for additional limitations of liability.
Your use of novablue-labs.com, including any sub-domains, affiliated websites, and mobile applications (collectively, the "Website"), which are owned and maintained by Novablue Labs LLC ("Novablue Labs," "we," "our," "us"), is governed by the terms below. We offer the Website, including all information, tools, products, and services available from the Website, conditioned upon your acceptance of all terms, conditions, policies, and notices stated herein.

We reserve the right to update, change, or replace any part of these Terms by posting updates to our Website. It is your responsibility to check this page periodically. Charges from Novablue Labs LLC appear on your card statement as "NOVABLUE" or "SP NovaBlue" If you do not recognize a charge, please contact us before disputing with your bank.
By using the Website and agreeing to these Terms, you represent and warrant that: (a) you are at least the age of majority in your state, province, or country of residence; (b) you have the legal capacity to enter into a binding contract; (c) you have read, understood, and agree to be bound by these Terms; and (d) all information you provide to us is accurate, current, and complete.

You agree not to use or attempt to use the Website or any products or services in any unlawful manner or for any unlawful purpose. You further agree not to commit or attempt to commit any of the following prohibited acts:
Novablue Labs LLC reserves the right to terminate or suspend your access to the Website and its services if we reasonably determine that you have violated these Terms, provided false information, or engaged in conduct that harms our rights, interests, or property. If we terminate your access, we will process any pending refund owed to you under our Refund Policy, except in cases of documented fraud.
Novablue Labs products are sold directly to consumers through the Website. We do not authorize third-party resellers, distributors, or marketplaces to sell Novablue Labs products. Products purchased from unauthorized third-party sellers are not covered by our satisfaction guarantee, warranties, or return privileges, and we cannot verify the authenticity, storage conditions, or expiration dates of such products.
We reserve the right to limit quantities per customer and to decline orders that appear to be for large-scale commercial resale purposes. Nothing in this section is intended to restrict rights you may have under applicable law, including the First Sale Doctrine under U.S. copyright law.
The material on the Website is provided for general informational and educational purposes only. All charges are processed in United States Dollars (USD) through Shopify Payments, our PCI DSS-compliant payment processor. By submitting payment information, you represent and agree that: (a) you are fully authorized to use the payment method; (b) all payment information provided is complete and accurate; (c) you are responsible for any payment card fees, foreign transaction fees, or other charges imposed by your financial institution; and (d) sufficient funds exist to pay the amount(s) due.
We do not store your full payment card information. Payment card details are collected and processed directly by Shopify Payments in accordance with PCI DSS standards.
We are not responsible for any fees or charges imposed by your bank or credit card issuer.
Your electronic order confirmation does not constitute acceptance of your order. We reserve the right to accept, deny, limit, or cancel any order for reasons including: product availability issues, pricing errors, suspected fraud, excessive order quantities, or shipping restrictions. If we cancel your order, a full refund will be issued to your original payment method.
We reserve the right to require additional verification or information before processing any order.
Novablue Labs LLC does not currently offer subscription products, recurring billing, or free-trial-to-paid conversions. All purchases through the Website are one-time transactions. You will not be automatically charged for future shipments, and no payment method on file will be used for any recurring charge.
Novablue Labs LLC ships to addresses in the United States and Canada. Delivery times vary by location and may be impacted by factors beyond our control. Please refer to our Shipping Policy for complete terms, including handling times, transit estimates, and carrier information.
You are solely responsible for providing an accurate shipping address and phone number. We are not responsible for shipments delayed or undeliverable due to incorrect address information. If you discover an error after submitting your order, contact us immediately at support@novablue-labs.com; we will make reasonable efforts to correct the address, but cannot guarantee modifications to orders already in fulfillment.
Risk of loss and title for products pass to you upon delivery to the carrier. Carrier tracking information will be provided as confirmation of shipment. If a package is marked as delivered by the carrier but you have not received it, please contact us within seven (7) days at support@novablue-labs.com. We will work with you and the carrier to investigate and, where appropriate, replace or refund the order.
Returns, refunds, and exchanges are governed by our Cancellation, Return & Refund Policy, which is incorporated into these Terms by reference. Please review that policy for complete eligibility requirements, procedures, and timeframes.
The following are non-refundable: (a) items marked "final sale"; (b) gift cards; and (c) orders paid with gift cards (store credit will be reissued instead).

THIS APPLIES REGARDLESS OF THE THEORY OF LIABILITY, WHETHER FOR BREACH OF CONTRACT, TORT (INCLUDING NEGLIGENCE), WARRANTY, OR OTHERWISE, AND REGARDLESS OF WHETHER NOVABLUE LABS LLC WAS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IF NOVABLUE LABS LLC IS FOUND LIABLE UNDER ANY THEORY, NOVABLUE LABS LLC'S TOTAL AGGREGATE LIABILITY AND YOUR EXCLUSIVE REMEDY SHALL BE LIMITED TO THE GREATER OF: (A) USD $500.00, OR (B) THE TOTAL AMOUNT YOU PAID TO NOVABLUE LABS LLC FOR THE SPECIFIC PRODUCT GIVING RISE TO THE CLAIM IN THE TWELVE (12) MONTHS PRECEDING THE EVENT.
Nothing in this Section 14 limits or excludes liability that cannot be limited or excluded by applicable law, including (a) liability for personal injury or death caused by our negligence; (b) liability for fraud or fraudulent misrepresentation; (c) product liability for defective products under applicable law; or (d) any statutory consumer rights. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you and you may have additional rights.
PLEASE READ THIS SECTION CAREFULLY. IT REQUIRES YOU TO ARBITRATE DISPUTES WITH NOVABLUE LABS LLC ON AN INDIVIDUAL BASIS AND LIMITS THE MANNER IN WHICH YOU CAN SEEK RELIEF.
You agree that any dispute or claim arising from or relating to these Terms, our Privacy Policy, our advertising or marketing practices, or our products or services shall be resolved by binding, final, and confidential arbitration before a single arbitrator administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, available at adr.org.
This arbitration provision is governed by the Federal Arbitration Act ("FAA"), 9 U.S.C. §§ 1–16. The arbitrator shall be bound by these Terms, shall have exclusive authority to determine arbitrability, and shall follow applicable substantive law of the State of Delaware to the extent consistent with the FAA. The arbitrator may award all remedies available in an individual lawsuit, including compensatory, statutory, and punitive damages, declaratory and injunctive relief, and attorneys' fees and costs where permitted by law.
Arbitration fees will be governed by the AAA Consumer Arbitration Rules, under which Novablue Labs LLC pays most fees for consumer-initiated arbitrations.
Notwithstanding the arbitration requirement, either party may bring an individual claim in small claims court in the party's county of residence if the claim qualifies for small claims jurisdiction.
THE ARBITRATOR MAY ONLY RESOLVE DISPUTES BETWEEN YOU AND NOVABLUE LABS LLC INDIVIDUALLY. THE ARBITRATOR MAY NOT CONSOLIDATE CLAIMS OR PROCEEDINGS WITHOUT NOVABLUE LABS LLC'S CONSENT AND MAY NOT HEAR CLASS, COLLECTIVE, OR REPRESENTATIVE CLAIMS OR REQUESTS FOR RELIEF ON BEHALF OF OTHER INDIVIDUALS.
Unless you timely opt out, you waive the right to: (a) have a court or jury decide your dispute; (b) obtain pre-hearing discovery to the same extent as in court; (c) participate in a class action in court or arbitration; (d) act as a private attorney general; or (e) join or consolidate your claim with any other person's claim.
If 25 or more similar arbitration demands are filed by or with the assistance of the same law firm or coordinated group within a 60-day period, the parties agree that such demands will be administered in staged batches of no more than 50 demands at a time, with the parties working in good faith with AAA to establish an efficient process. This provision is intended to promote efficient resolution and does not affect the substantive rights of any individual claimant.
Notwithstanding the foregoing, Novablue Labs LLC retains the right to bring a claim against you in the state or federal courts of Delaware for injunctive relief, equitable relief, or any claim arising from the potential or actual misappropriation or infringement of Novablue Labs LLC's intellectual property rights. You consent to personal jurisdiction and venue in such courts for these limited purposes.

The notice must include your full name, the product purchased, order number, and a clear statement of your intent to opt out of arbitration. Opt-out requests received after the 30-day window will not be honored.
If a court or arbitrator determines that any part of this arbitration provision cannot be enforced as to a particular claim or remedy, then that specific claim or remedy (and only that claim or remedy) shall proceed in court, and all remaining claims shall continue in arbitration.
To the fullest extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Novablue Labs LLC, its parent companies, subsidiaries, predecessors, successors, affiliates, and their respective partners, officers, directors, agents, representatives, contractors, licensors, service providers, subcontractors, suppliers, and employees from and against any and all claims, actions, losses, liabilities, damages, expenses, demands, and costs of any kind (including reasonable attorneys' fees) arising from or related to: (a) your breach of these Terms or any document incorporated by reference; (b) your breach of any representation or warranty in this Agreement; (c) your violation of any applicable law or the rights of any third party; (d) your misuse of any Novablue Labs product in a manner contrary to product instructions; or (e) any content you submit to the Website.
All content on the Website, including text, graphics, logos, images, product photography, videos, illustrations, designs, software, and audio ("Content"), is owned by Novablue Labs LLC or its licensors and is protected by copyright, trademark, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable license to access and view the Content for personal, non-commercial purposes only. You may not: (a) copy, reproduce, distribute, publish, display, or transmit any Content; (b) modify, adapt, translate, or create derivative works from any Content; (c) download, stream-capture, or archive any Content beyond personal browser caching; (d) sell, rent, lease, license, sublicense, or commercially exploit any Content; (e) use any automated means (bots, scrapers, crawlers) to access or index the Content; or (f) build any product, service, or enterprise using the Content.
The trademarks, service marks, trade names, and logos ("Trademarks") displayed on the Website are registered and unregistered Trademarks of Novablue Labs LLC. Nothing on the Website grants any license or right to use any Trademark without the prior written consent of Novablue Labs LLC.
The copyright in all materials on the Website is owned by Novablue Labs LLC or its affiliates. Permission is granted to view, print, and download materials for personal, non-commercial, informational use only, provided all copies include the applicable copyright notice.

You acknowledge that testimonials displayed on the Website represent individual experiences and do not represent typical or guaranteed results. We may edit, supplement, or contextualize Submissions with disclaimers required by applicable law (including "results not typical" disclosures) without altering your substantive experience.

Novablue Labs LLC shall not be liable for any delay or failure to perform any obligation under these Terms resulting from causes beyond our reasonable control, including natural disasters, severe weather, pandemics, epidemics, government actions or restrictions, war, civil unrest, terrorism, strikes, labor disputes, carrier disruptions, supply chain interruptions, cyberattacks, utility failures, or any other event that could not have been reasonably foreseen or prevented.
You may not assign or transfer any of your rights or obligations under these Terms without our prior written consent. Any attempted assignment without consent is null and void. Novablue Labs LLC may freely assign, transfer, or delegate its rights and obligations under these Terms to any affiliate, successor, or third party in connection with a merger, acquisition, reorganization, or sale of assets.
No failure or delay by Novablue Labs LLC in exercising any right, power, or remedy under these Terms shall operate as a waiver of that right. No single or partial exercise of any right shall preclude any other or further exercise. No waiver shall be effective unless made in writing and signed by an authorized representative of Novablue Labs LLC.
If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision shall be enforced to the fullest extent permitted by law, and the unenforceable portion shall be severed. Such determination shall not affect the validity or enforceability of any remaining provisions.
Novablue Labs LLC may terminate or suspend your access to the Website for cause as described in Section 3. Upon termination, Sections 2, 4, 5, 12–20, and 22–30, as well as any representations, warranties, indemnification obligations, and other obligations that by their nature should survive, shall continue in full force and effect.
These Terms, together with our Privacy Policy, Shipping Policy, and Cancellation, Return & Refund Policy, constitute the entire agreement between you and Novablue Labs LLC regarding the Website and supersede all prior or contemporaneous agreements, understandings, representations, and warranties.
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States of America, without regard to its conflict of law provisions. The Federal Arbitration Act governs the interpretation and enforcement of the arbitration provisions in Section 15. For any claims not subject to arbitration, you consent to the exclusive jurisdiction of the state and federal courts located in Delaware.
Canadian residents retain rights under applicable federal and provincial consumer protection legislation that cannot be waived, and may bring proceedings in the courts of their province of residence to the extent required by such legislation.

Ok so I bought this after seeing it on Facebook and honestly I almost didn't because I've wasted so much money on leg makeup. BUT WOW. The spider veins behind my knees are basically gone when this is on. I'm 56 and haven't worn a dress in like 7 summers. Just wore one to a baby shower last weekend. My sister kept staring at my legs lol.
The age spots on the back of my hands have driven me crazy for years. I'm 61 and they made me feel SO old. This evens everything out. Has to dry a few mins before I touch anything but once it sets its fine. Took it on vacation, used it daily for a week, no issues. Will def buy again.
I've used Sally Hansen for years and was always disappointed. Too sheer, didn't cover anything. Tried Dermablend, way too heavy and looked fake. This is the one ya'll. Covers my spider veins AND the sun spots on my shins. I let it dry like 10 mins like the directions say and it doesn't budge. Tip: get the brush, makes a huge difference.
Was looking into sclerotherapy and the derm wanted $400+ per session and said I'd need 2 or 3. Decided to try this first. Best decision. The veins on the back of my calves look completely smoothed out. Im 58 and paying the price for the baby oil and foil tanning of the 80s lol. My chest and shoulders got so blotchy I stopped wearing v-necks. Used this for my niece's wedding last month. My husband said I looked like myself again. Almost cried. Ordered another one already.
Game changer for the spider veins on my inner thighs. Had them like 8 years. The trick is letting it dry all the way, like the instructions say. Pricey but a little goes a long way I swear. I've had mine almost 5 months and barely made a dent. The age spots on my forearms blend right in, doesn't outline them like other products did. Takes a few minutes to dry, just be patient. 10/10 would recommend. My daughter stole it from me last week and now she wants her own.
